By purchasing from www.paddle-power.nz you agree to our Terms and Conditions outlined here. Please read them before you use this website. You will find information about your rights and obligations as well as limitations and exclusions that apply to your purchase.
This website (“paddle-power.nz”) is operated by Topline Agencies NZ Limited (referred to in these Terms and Conditions as “The Company”, “Ourselves”, “we” and “us”). “Customer”, “You” and “Your” refers to you – the person accessing this website and accepting the Company’s terms and conditions.
These terms and conditions apply to all purchases between You and the Company.
All prices published on this website are in New Zealand Dollars (NZD) and include 15% Goods and Services Tax (GST).
If you are accessing this website from overseas prices will be listed without GST, and any products ordered and shipped to an overseas address will be charged at GST-exclusive prices.
If you are an approved trade customer and logged in to your account prices shown may be exclusive of GST, but this is clearly stated next to the item’s price.
3) PRODUCT AVAILABILITY
Topline Agencies NZ Limited cannot guarantee availability of all products, and cannot guarantee that all items will be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available, any or all products, or to cancel any order. If there is any revision, discontinuance, or cessation, we may offer a similar product.
However, we do our best to have key products in stock at most times, and if a product is unavailable we’ll give you a call or send you an email to discuss options.
4) ERRORS ON THIS WEBSITE
We make an effort to make all information on this website as accurate as possible. However, in the event of a product being listed at an incorrect price, or with incorrect information due to a typographical error, or an error in pricing or product information, or unexpected lack of stock, we shall have the right to refuse or cancel any orders placed for any such product(s). We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge.
5) ORDER PROCESSING
When we receive your purchase order you will be notified by email. We review all purchase orders to ensure they are complete and that they include all contact information we need for the delivery. We will contact you if we need any more information to process your order. Complete orders are processed within 48 hours (excluding weekends).
Please note that we only dispatch orders that have been paid for in full, including freight charges if applicable, unless you have a trade account with the Company.
If all item(s) you ordered are in stock we will dispatch your order within 2 business days. If for some reason any of the items you ordered are out of stock, we will contact you with options like; alternative product, making a back order, issue a full or partial refund.
6) DELIVERY POLICY
We are using local courier or freight companies for delivery. Delivery costs vary with your location. We have different delivery rates for the North and the South Island of New Zealand. Rural surcharges may apply.
Shipping to overseas locations will be with NZ Post Airmail unless requested otherwise. Contact us for delivery time estimates.
Target delivery times in New Zealand:
North Island – 1 to 2 working days
South Island – 2 to 3 working days
Rural Delivery – can be 1 – 2 extra days
The above delivery times are guidelines only, provided by the delivery companies. Deliveries occur on business days only although Saturday delivery may be available on request.
Stewart Island and other coastal islands of New Zealand: please notify us at time of order.
Ensure that you check your shipment for damage of goods or missing items BEFORE you sign for delivery. The title to products and risk of loss or damage passes from the Company to the customer upon delivery by the shipping company.
Delivery of kayaks will always be charged depending on destination. Please contact us before placing an order.
7) SHIPPING AND HANDLING
Shipping and handling charges are added to online orders.
Should you have any questions or concerns regarding these charges, please contact us.
All products purchased from Topline Agencies NZ Limited through associated stockists or on this website are covered by a 12 month warranty. Some products may have an extended manufacturer’s warranty. The warranty covers faults in materials and workmanship, but not wear and tear or excessive use.
To make a warranty claim first contact the shop where you purchased the goods from.
A claim must be accompanied by proof of purchase (payment receipt or invoice copy) or it may not be able to be considered. Any faulty items must be sent back to us so we can inspect them and discuss the fault with the manufacturer. Goods must be in dry and clean condition when returned.
If damage to an item is determined to be a warranty case we reserve the right to either repair or replace it. If a product is no longer available we may offer you an alternative product or refund.
9) RETURN POLICY
Please choose carefully as we do not issue a refund if you simply change your mind. We will however help you to exchange a product if you have purchased the wrong size or colour. Products that were on Sale on this website cannot be returned or refunded.
Before returning an item to Topline Agencies NZ Limited please notify us first by phone or email (details here). For your own security we suggest you send the product back to us by courier, signature required.
Returned products must be:
• unused and complete, including all accessories, and product tags attached
• in their original inner and outer packaging
• received within 14 days from the date of purchase.
Please include a copy of the invoice.
It is the responsibility of the Customer to pay for shipping of the returned goods.
We reserve the right to refuse the return of incomplete, damaged, used or otherwise non-conforming returns, and to charge a restocking fee of 15% on any such item.
10) REFUND POLICY
We only refund approved warranties and once we have explored all other ways of repairing or replacing the product for you. We will repair the product, if it is repairable; we will replace the product, if it is not repairable; and we will offer an alternative or better product if the identical product is no longer available.
If you are eligible for a refund we will reverse the original method of payment within 3 working days.
Freight charges and packaging charges are not refundable.
11) LIMITATION OF LIABILITY
In no event shall Topline Agencies NZ Limited be liable for damages, loss of business or profit, harm of health, injury or death in relation to the use of any product purchased from Us or through any of our associated stockists.
12) DISPUTE RESOLUTION
We will endeavour to solve all customers’ issues by mutual agreement. In case an agreement can’t be reached, in the case of a dispute, controversy or claim arising out of or relating to your purchase of any product from Topline Agencies NZ Limited, New Zealand law applies.
13) GOVERNING LAW
These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand.

You can review the most current version of the Terms and Conditions at any time on this page.
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.
